Special Needs Planning often incorporates First Party Special Needs Trusts to protect assets held by the special needs individual, Third Party Special Needs Trusts to receive inheritances and other gifts for the special needs individual, as well as advising our clients with respect to the appropriate use of pooled trusts and ABLE accounts, where applicable.
In almost all situations, our clients hold in their head all of the information that a caregiver would need to care for their special needs loved one. We encourage all of our Special Needs Plans to incorporate a Care Memorandum, so that the caregivers you select for your Special Needs loved has all of the information they need at their fingertips.
We also encourage and facilitate a “Needs Analysis” for Special Needs loved ones, to ensure clients leave sufficient assets to protect and provide for their needs.
